1. Introduction

Welcome to PeakaPool ("we", "our", "us"). These Terms & Conditions govern your use of our website and ride-sharing platform. By accessing or using our service, you agree to be bound by these terms. If you do not agree with these terms, please do not use our service.

2. Service Description

PeakaPool is a platform that connects individuals ("Users") to facilitate non-commercial, cost-sharing rides to ski fields. We are a neutral facilitator and are not a transportation carrier, taxi service, or a party to any ride agreement between Users. We do not guarantee the quality, safety, or legality of the rides offered.

3. User Obligations

All Users

- You must be at least 18 years of age to create an account.
- You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
- You agree to act respectfully and lawfully in all interactions with other Users.

Drivers

- You must hold a valid, current driver's licence for the vehicle you are operating.
- The vehicle you use must be in a safe, roadworthy condition, fully insured, and have all required certifications (e.g., Warrant of Fitness in New Zealand).
- You are responsible for ensuring your insurance policy covers carpooling with passengers.
- You agree to drive safely and adhere to all traffic laws.

Passengers

- You are responsible for your own safety and belongings.
- You agree to respect the driver's vehicle and rules.

4. Payments

The price for a seat is set by the driver to cover vehicle running costs and is not for commercial profit. The price is assumed to be in the local currency of the country where the ride takes place. All financial transactions for rides are handled directly between the driver and the passengers. PeakaPool does not process payments, handle cash, or provide any payment guarantees. Users are solely responsible for arranging and completing payment for the agreed-upon price.

5. Cancellations and Punctuality

We understand plans can change. Timely communication is key to a smooth experience for everyone.

For Passengers

If you need to cancel a booking, please do so as early as possible through the "My Booked Trips" page. This gives the driver a chance to offer the seat to someone else.

  • Standard Cancellation: You can cancel your booking at any time.
  • Short-Notice Cancellation: A cancellation made within 10 hours of the scheduled departure time is considered short-notice. While there is no financial penalty from PeakaPool, we strongly encourage you to message your driver directly as a courtesy.
  • No-Shows: Failing to show up for a ride without cancelling is disruptive. Repeated short-notice cancellations or no-shows may result in a lower user rating or account suspension.

For Drivers

If you must cancel a ride, please do so from the "My Posted Rides" page as soon as possible. This will automatically notify all confirmed passengers. Cancelling frequently or at the last minute can negatively impact the community's trust and may lead to account suspension.

6. Limitation of Liability

Our platform is provided "as is" without warranties of any kind. We are not liable for any incidents, accidents, injuries, damages, or disputes that occur between users. Your use of the service is entirely at your own risk. We do not conduct background checks on our users.

7. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms & Conditions on this page. Your continued use of the service after such changes constitutes your acceptance of the new terms.
